Terms of Service

1. Acceptance of Terms

By accessing or using Yarda AI Landscape Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Yarda provides an AI-powered landscape design generation service that creates landscape design visualizations based on property addresses you provide. The Service uses artificial intelligence, satellite imagery, and street view data to generate design concepts.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account using Google OAuth authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Account Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3.3 Account Security

You are responsible for safeguarding your account. Notify us immediately of any unauthorized use of your account or any other security breach.

4. Trial Credits and Payment

4.1 Trial Credits

New users receive 3 free trial credits upon account creation. Each credit allows you to generate one landscape design for one property area. Trial credits:

• Are non-transferable and non-refundable
• Expire if not used within reasonable time (we reserve the right to set expiration policies)
• Cannot be combined with other offers unless explicitly stated
• Are provided on a one-time basis per user

4.2 Paid Credits

After exhausting trial credits, you may purchase additional credits or subscribe to a plan. Paid credits:

• Are purchased through Stripe payment processing
• Are deducted when a generation is successfully completed
• Do not expire unless your account is terminated
• Are non-refundable except as required by law or in cases of service failure

4.3 Subscriptions

Monthly Pro subscription plans provide recurring credits and benefits. Subscriptions:

• Automatically renew monthly unless canceled
• Can be canceled at any time via the billing portal
• Remain active until the end of the current billing period after cancellation
• Do not provide refunds for unused credits in the current billing period

4.4 Pricing Changes

We reserve the right to modify pricing at any time. Price changes will not affect active subscriptions until renewal, and you will be notified in advance.

5. Refund Policy

Due to the nature of our AI generation service (immediate delivery of digital content), we generally do not provide refunds. However, we may provide refunds or credits in the following cases:

• Service failure or technical issues preventing generation
• Billing errors or duplicate charges
• Credits deducted without successful generation completion
• As required by applicable law

Refund requests must be submitted within 14 days of the transaction via privacy@yarda.pro.

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any laws
• Submit addresses of properties you do not own or have permission to use
• Attempt to reverse engineer, decompile, or extract the AI models or algorithms
• Use automated means (bots, scrapers) to access the Service without permission
• Abuse trial credits by creating multiple accounts
• Share account credentials with others
• Harass, abuse, or harm other users or our staff
• Upload malicious content or attempt to compromise Service security

7. Intellectual Property

7.1 Generated Content Ownership

You retain ownership of the landscape design images generated through the Service. However, we retain the right to use generated images for:

• Service improvement and AI model training
• Marketing and promotional materials (anonymized)
• Quality assurance and debugging

7.2 Service Intellectual Property

The Service, including its AI models, algorithms, design, and software, are owned by Yarda and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.

7.3 Third-Party Content

The Service uses Google Maps imagery and satellite data. Such content is subject to Google's terms and may have separate licensing restrictions.

8. Disclaimers and Limitations

8.1 Service "As-Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 AI-Generated Content Disclaimer

Generated landscape designs are AI-created visualizations and may not be architecturally accurate, structurally sound, or suitable for actual implementation. Designs are for inspirational purposes only. Consult licensed professionals before implementing any landscape design.

8.3 No Guarantee of Results

We do not guarantee that generated designs will meet your expectations, be free from errors, or be suitable for any particular purpose.

8.4 Service Availability

We do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable for maintenance, updates, or due to technical issues.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YARDA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or your data
• Any errors or omissions in generated content
• Implementation of AI-generated designs

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other reasons we deem necessary. You may terminate your account at any time by contacting us. Upon termination:

• Your access to the Service will be revoked
• Unused credits will be forfeited (no refunds)
• Active subscriptions will be canceled
• Your data may be deleted after a retention period

11. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or Service notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
